§ II

Abstract

On the scope of the work.

A practitioner's manual on the principal federal consumer-credit statutes — the Fair Debt Collection Practices Act and the Fair Credit Reporting Act — and the implementing regulations.

§ III

Editorial Description

On the structure of the volume.

The manual reads each statute section by section, with the corresponding regulation and the leading appellate authority placed beside the text.

Part I treats the FDCPA: who is a debt collector, what communications are prohibited, what disclosures are required, and what remedies attach to a violation.

Part II treats the FCRA: the duties of consumer reporting agencies, the duties of furnishers, the dispute procedure, and the private right of action.

Each chapter closes with a checklist of the elements a practitioner must establish, and the documents that would establish them.
